TERMS OF SERVICE These Terms of Service (“Terms”) govern the purchase and participation in sailing courses offered by Northern Horizon Sailing Academy (“NHSA”, “we”, “us”, or “our”). By registering for a course, you (“participant”, “you”, or “your”) agree to the following Terms. 1. BOOKINGS AND PAYMENT (a) All course registrations must be completed through our official registration system or as otherwise approved by NHSA. (b) Full payment is required at the time of booking unless otherwise stated. (c) All fees are listed in Canadian dollars. (d) Your booking is not confirmed until payment has been received in full. 2. CANCELLATION AND REFUND POLICY (a) Participant Cancellations - Cancellations made 7 or more before the course start date: Full refund minus a $50 administrative fee. - Cancellations made less than 7 days before the course start date: No refund. (b) NHSA Cancellations NHSA reserves the right to cancel or reschedule a course due to insufficient enrollment, instructor availability, weather, or other unforeseen circumstances. In such cases, participants will be offered: - A full refund; or - Transfer to a future course date. 3. WEATHER POLICY (a) Sailing is weather-dependent. Courses will proceed in a range of conditions at the discretion of the instructor. (b) NHSA reserves the sole right to modify, delay, or cancel sessions due to unsafe weather conditions. (c) Missed time due to weather may be rescheduled where feasible but is not guaranteed. 4. MINIMUM ENROLLMENT Courses require a minimum number of participants to run. If minimum enrollment is not met, NHSA may cancel or reschedule the course and provide options outlined in Section 2(b). 5. PARTICIPANT RESPONSIBILITIES (a) Participants must: - Follow all instructions provided by NHSA staff and instructors; - Act in a safe, respectful, and responsible manner at all times; - Refrain from behavior that may endanger themselves or others. (b) NHSA reserves the right to remove any participant from a course without refund for unsafe or inappropriate behavior. 6. SAFETY AND INSTRUCTOR AUTHORITY (a) The instructor has full authority over all safety-related decisions, including participation, use of equipment, and continuation of activities. (b) Participants must comply immediately with all safety instructions. Failure to do so may result in removal from the course without refund. 7. NHSA reserves the right to update or modify these Terms at any time. Updated Terms will be posted on our website and will apply to all future bookings. By registering for a course, you acknowledge that you have read, understood, and agree to these Terms of Service. LIABILITY WAIVER, ASSUMPTION OF RISK & MEDIA RELEASE AGREEMENT Every effort is made by Northern Horizon Sailing Academy (NHSA) to provide safe, on-water instruction at the sole discretion of the Head Coach. Sailing and boating activities involve inherent risks that may result in injury, illness, property damage, or death. By registering for and participating in any program offered by Northern Horizon Sailing Academy, the participant (or parent/guardian if the participant is under 18) acknowledges and agrees to the following: 1. Assumption of Risk I understand that sailing and boating activities take place on open water and may involve risks including but not limited to changing weather conditions, capsizing, collisions, equipment failure, slips and falls, and other hazards associated with marine environments. I voluntarily choose to participate in Northern Horizon Sailing Academy programs and accept full responsibility for all risks associated with participation, whether foreseeable or unforeseeable. 2. Release of Liability By registering in NHSA sailing programs, I consent to: Release and hold harmless Northern Horizon Sailing Academy, its agents, executives, directors, staff, instructors, volunteers, and guests from any and all actions, claims, demands, or causes of action arising out of or related to loss of life, personal injury, illness, or damage or loss of property that may occur during or as a result of participation in NHSA programs. Use the NHSA facilities, vessels, and equipment solely at my own risk. 3. Binding Agreement I understand and agree that this release of liability is binding upon myself, my heirs, executors, administrators, and assigns. 4. Acknowledgement By signing below, I confirm that: I have read and understood this agreement. I voluntarily agree to its terms. I understand that I am giving up certain legal rights, including the right to sue.
